By accessing or using Plumhire's website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
Plumhire provides a barebones applicant tracking system (ATS) that helps you manage job postings and candidates. We may offer integrations, including with LinkedIn, to post jobs and manage recruiting workflows. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
3. Account
You may need to create an account to use certain features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 18 years old and legally able to enter into contracts to use the Service.
4. Acceptable Use
You agree to use the Service only for lawful purposes. You will not: (a) violate any applicable laws; (b) infringe others' intellectual property or privacy rights; (c) transmit harmful or malicious code; (d) attempt to gain unauthorized access to our systems or other accounts; (e) use the Service for spam or fraudulent activity; or (f) interfere with the integrity or availability of the Service.
5. Your Content
You retain ownership of the content you submit to the Service (e.g., job postings, candidate data). By submitting content, you grant us a limited, non-exclusive license to use, store, and display it as needed to provide and improve the Service. You represent that you have the right to provide such content and that it does not violate these Terms or any third-party rights.
6. Third-Party Services
The Service may integrate with third-party services such as LinkedIn. Your use of those services is subject to their respective terms and policies. We are not responsible for third-party services or their availability.
7. Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. Your use of the Service is at your own risk.
8. Limitation of Liability
To the maximum extent permitted by law, Plumhire and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim, or one hundred dollars ($100), whichever is greater.
9. Indemnification
You agree to indemnify and hold Plumhire and its affiliates harmless from any claims, damages, or expenses (including attorney fees) arising from your use of the Service, your content, or your violation of these Terms.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases. Sections that by their nature should survive (e.g., Disclaimer, Limitation of Liability, Indemnification) will survive termination.
11. Changes
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.
